Actually, it's pretty easy how he can and probably will avoid it. Ichiro will be batting leadoff (or Gardner) and Jeter bats 2nd. He did that a few times last season as well.

No problem, Cervelli or Stewart bat 3rd... We obviously feel any catcher will do, so why not any hitter batting 3rd..

Haven't seen anything official but NYT had the following. I'm assuming it will be very similar to Ibanez' deal.

He has agreed to an incentive-laden deal with the Yankees with a base salary close to $2 million.

Edit: Arod would make it through waivers (unfortunately).

Edit again: he would need to give consent to be sent to the minors ... but it would be sweet if they could arrange that consent. He would still get paid his money, but he wouldn't be on the 40 man roster, so it wouldn't count against the luxury tax. [/Dreaming]
