    Disproportionate for sure. There are about 315,000,000 people in the USA, and 4,300,000 members of the NRA. That's about 1.36% of the population. Yet no Republican can get elected to office without their support. And to keep getting elected, they need to keep voting the way the NRA wants them to.

    Except the militia, back in the 1770s was the only Army we had.
    The Continental Army was formed after the outbreak of the American Revolutionary War by the colonies. Established by a resolution of the Continental Congress on June 14, 1775, it was created to coordinate the military efforts of the Thirteen Colonies in their revolt against the rule of Great Britain.

    When the American Revolutionary War began at the Battles of Lexington and Concord in April 1775, the colonial revolutionaries did not have an army. Previously, each colony had relied upon the militia, made up of part-time citizen-soldiers, for local defense, or the raising of temporary "provincial regiments" during specific crises such as the French and Indian War. As tensions with Great Britain increased in the years leading up to the war, colonists began to reform their militia in preparation for the potential conflict. Training of militiamen increased after the passage of the Intolerable Acts in 1774. Colonists such as Richard Henry Lee proposed creating a national militia force, but the First Continental Congress rejected the idea.

    That's essentially correct, and it's no longer a matter for debate - it's settled law under Heller and McDonald. The Second Amendment guarantees "the individual right to possess and carry weapons in case of confrontation." The cases specifically address possession of a handgun within the home, but obviously establish a broader right than that.

    How much broader it is remains to be established. Scalia clearly states that the Second Amendment right is not absolute and can be limited in various ways. He cites precedents that held that "prohibitions on carrying concealed weapons were lawful under the Second Amendment," and goes on to affirm that
    nothing in our opinion should be taken to cast doubt on longstanding prohibitions on the possession of firearms by felons and the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings, or laws imposing conditions and qualifications on the commercial sale of arms.

    That comparison is wrong in more ways than I can count at the moment. You've got a better shot with Plessy v. Ferguson, and even that's a terrible comparison.

    Heller was a strongly-written opinion that established a fundamental right. What's your theory on how it gets overturned? What does the test case look like, and how does it get to the Supreme Court?

    Once a fundamental right is established, it doesn't get overturned easily. There may well be instances where it's happened, but I'm hard pressed to think of one.

    I saw that Eric. How freakin sad. The article says people randomly go around shooting people like that in that Chicago area. It seems worse since the Newtown tragedy or maybe it's just my imagination. I hope they catch the asshole that shot this innocent girl and throw him behind bars for life.

    While I see little use for basically military style guns in hunting, I don't think the guns themselves are the problem, it's why we value guns and violence in this country and how we treat each other that is the issue. That can't be regulated.
