I'm currently listening to Joe Beningo's show and Rich Eisen is his guest. Eisen said that Steinbrenner has gone ahead and retained David Boises. I can't find any links on the net about this so if anyone else has heard similar, please post!

But anyway, assuming Boises has been brought on, what do you lawyers and legal beagles think about this?

I'm not a lawyer so I'll let them speak to the ramifications but here's one snippet:

NY Daily News: Luxury Tax Meant to Kill Yankees

He has also asked noted New York attorney David Boies, who he has had on retainer since baseball attempted to block his marketing deal with Adidas, to explore legal remedies for any significant hit the Yankees might take in this labor deal.

I think Steinbrenner retained Boies a little over a week ago on this issue specifically...I've seen mention of it in a few articles...try doing a search for the name Boies -- hope that helps. :)

Boies is already working for Steinbrenner on the Cablevision case and as I understand it has been asked to look into revenue sharing/luxury tax thing as well. Which is why there will not be a strike. Selig knows that if he doesn't rein in his hardliners and get some deal that Steinnbrenner and the players (who are basically on the same side) can live with, then MLB stands a real chance of losing its anti-trust exemption. Once that happens there wouldn't be a thing to prevent George and 15 other big market owners from getting together and forming their own "super" league, and telling Selig and Moores and the other small fry to go to hell.

I don't understand why Steinbrenner is whining. He spends massive amounts of money, sometime foolishly (Hitchcock, R Rivera, Morales, Henson). Stop throwing money around to medicore players George and the tax hit will come down. Look, I'm a yankee fan for life but I will admit that we have an extreme unfair advantage over other teams. There is no way that the Royals, DRays and Padres can just double their payroll without suffering huge losses, Even if they sold out every game.

I do not see how George can win this battle. Every single owner is againts him. There was nothing the Bulls could do about the last NBA CBA.

That sound right
